Axel is the first of 25 grandsons of Santo, but his attempts to name himself as such (El Nieto de Santo) has caused a split in the Santo family. El Hijo del Santo claims to hold all related Santo trademarks, as he was the only one of Santo's sons who wrestled.

With control of the Santo of name, El Hijo del Santo sued Axel to stop using the Nieto name - Hijo obviously wants to save the name for at least one of his sons (Santo Jr., who never had his heart in the business and only ever appeared on his father's shows), but has also claimed that Axel isn't great enough to carry on the high standards of the Santo name. Axel disagrees, and there are members of the Santo family that agree with him (and disagree with Hijo del Santo's handling of the names), but Hijo del Santo's right to control the Santo name and trademarks has held up to this point.

Axel still tries to make that connection to Santo as clear as legally possible, wearing a similar mask and being promoted as the grandson of Santo, at times using Santo's birth name instead of the trademarked identity. He's still marketed as Nieto de Santo, even if he can't use the name.

Axel was very close to his father-in-law, Huracan Ramirez, before his death. They had a shared history of legal entanglements about what names they could use.

Hijo del Santo's standing in the industry has kept Axel out of major companies. It was likely no coincidence Axel was rumored to come into CMLL soon after Hijo del Santo split. He eventually did make his CMLL return on April 4, 2008. Axel continued to book himself as an independent while working with CMLL, which CMLL appears to frown on. After Axel worked a Guadalajara lucha libre festival in November which was running against the weekly Guadalajara show there, CMLL stopped using Axel (though they never told him why, or even that they were no longer using him.)
